The issue here is whether the trial court has jurisdiction over this suit for retaliatory discharge despite the plaintiffs failure to exhaust her administrative remedies when the defendant did not tell her such remedies existed. The trial court concluded that it lacked jurisdiction and dismissed the case. The court of appeals reversed and remanded, holding that jurisdiction must be determined solely on the plaintiffs pleadings. ___ S.W.3d ___ (Tex. App.-Dallas 2000). We agree with the trial court.
